Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the TourThru.com and/or TourThru.info website and related services (collectively, the "Service") operated by TourThru Real Estate Marketing, LLC ("TourThru," "us," "we," or "our").

These Terms govern your access to and use of the Service, including but not limited to our website, photography services, virtual tours, drone media services, floor plans, hosted media content, and related real estate marketing services.

By accessing or using the Service, requesting Services, or receiving Media from TourThru Real Estate Marketing, LLC, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Communications

By contacting TourThru Real Estate Marketing, LLC, requesting Services, submitting information through our website, or otherwise communicating with us, you agree that we may contact you regarding scheduling, service updates, project delivery, billing, customer support, promotional offers, and other business-related communications.

You may opt out of promotional or marketing emails at any time by following the unsubscribe instructions included in such communications. Transactional or service-related communications may still be sent as necessary for the operation of the Service.

2. Client Information

By using the Service or requesting Services from TourThru Real Estate Marketing, LLC, you represent that you are at least 18 years of age and authorized to enter into these Terms.

You agree to provide accurate, complete, and current information when communicating with us, scheduling Services, granting property access, or requesting media-related work. This includes, but is not limited to, property information, scheduling details, contact information, access instructions, and billing information.

You are responsible for ensuring that all information provided to TourThru Real Estate Marketing, LLC is accurate and up to date. We are not responsible for delays, service issues, missed appointments, or additional costs resulting from inaccurate or incomplete information provided by the client or their representatives.

We reserve the right to refuse or discontinue Services at our sole discretion.

3. Property Access Authorization

By requesting or scheduling Services, the client represents and warrants that they have the legal authority and permission necessary to grant TourThru Real Estate Marketing, LLC access to the property and to authorize the capture, creation, publication, distribution, and marketing use of photographs, videos, 360-degree images, virtual tours, hosted tour content, drone imagery, floor plans, and related Media associated with the property or project.

The client is responsible for obtaining any necessary permissions, approvals, authorizations, or consents from property owners, occupants, tenants, landlords, homeowners associations, property managers, or other relevant parties prior to the performance of Services.

The client further represents that they have the authority to authorize the publication and distribution of the Media for lawful marketing and promotional purposes related to the property or project.

TourThru Real Estate Marketing, LLC is not responsible for disputes relating to property access, occupant notification, ownership claims, privacy concerns, publication authorization, HOA restrictions, or the client’s authority to request Services.

4. Intellectual Property & Website Content

The Service and its original content, features, functionality, branding, logos, text, graphics, software, design elements, and related materials are and will remain the exclusive property of TourThru Real Estate Marketing, LLC and its licensors. The Service is protected by copyright, trademark, and other applicable laws of the United States and foreign jurisdictions.

TourThru Real Estate Marketing, LLC trademarks, trade dress, branding, logos, and website content may not be copied, reproduced, distributed, modified, displayed, or used in connection with any product or service without the prior written consent of TourThru Real Estate Marketing, LLC.

Nothing in these Terms grants any ownership rights or license to use TourThru Real Estate Marketing, LLC's intellectual property except as expressly stated herein.

5. Media Ownership & Client License

Unless otherwise agreed in writing, all photographs, videos, 360-degree images, virtual tours, hosted tour content, drone imagery, floor plans, marketing materials, and other media created by TourThru Real Estate Marketing, LLC ("Media") remain the sole intellectual property of TourThru Real Estate Marketing, LLC and are protected by applicable copyright laws.

Upon full and timely payment for the applicable Services, TourThru Real Estate Marketing, LLC grants the client a limited, non-exclusive, non-transferable license to use the delivered Media solely for lawful marketing and promotional purposes related to the specific property or project for which the Media was originally created.

This license includes:

MLS and real estate listing uploads
IDX and syndicated listing distribution
Brokerage and agent marketing
Social media promotion
Print and digital advertising related to the property
Promotional use associated with the sale or lease of the property

This license does not transfer copyright ownership to the client, property owner, broker, tenant, or any third party.

Unless expressly authorized in writing by TourThru Real Estate Marketing, LLC, the client may not:

Sell, sublicense, transfer, or distribute the Media to third parties unrelated to the original listing or project
Permit use of the Media by another agent, broker, photographer, business, or marketing company not originally associated with the purchase of the Services
Use the Media for AI training datasets, machine learning systems, or automated image-generation systems
Alter, edit, or manipulate the Media in a manner that materially misrepresents the property or falsely represents the work of TourThru Real Estate Marketing, LLC
Use the Media for unlawful, defamatory, misleading, or deceptive purposes

Any unauthorized use of the Media or violation of these Terms may result in automatic termination of the license granted under this Section and may constitute copyright infringement under applicable law.

The client acknowledges that certain third-party platforms, including Multiple Listing Services (MLS), IDX providers, real estate syndication services, brokerage platforms, and related real estate marketing services, may require sublicensing, display, distribution, or reproduction rights in order to publish and distribute listing content. Subject to these Terms, TourThru Real Estate Marketing, LLC grants the client the limited right to provide such permissions as reasonably necessary for the marketing and promotion of the specific property or project for which the Media was originally created.

Nothing in these Terms transfers copyright ownership of the Media to any MLS, brokerage, platform, or third party.

TourThru Real Estate Marketing, LLC reserves the right to use the Media for portfolio, marketing, promotional, educational, competition, and demonstration purposes unless otherwise agreed in writing prior to the performance of Services.

6. Scheduling, Property Readiness, Weather & Cancellation

Clients are responsible for ensuring that the property is reasonably prepared, accessible, and safe for the performance of Services at the scheduled appointment time. Property preparation, staging, cleanliness, lighting, access arrangements, and utility availability are the responsibility of the client unless otherwise agreed in writing.

TourThru Real Estate Marketing, LLC is not responsible for the condition, appearance, cleanliness, staging, furnishing, occupancy status, or readiness of a property at the time Services are performed.

If a property is not ready, inaccessible, unsafe, occupied in a manner that interferes with Services, or materially different from what was represented at the time of scheduling, TourThru Real Estate Marketing, LLC reserves the right to reschedule, modify, limit, or discontinue Services at its sole discretion. Additional fees may apply for return visits, excessive delays, extended onsite time, or rescheduling caused by property readiness or access issues.

Certain Services, including drone photography and exterior photography, are dependent on weather conditions, lighting conditions, FAA restrictions, safety considerations, equipment limitations, and other factors outside the control of TourThru Real Estate Marketing, LLC. We reserve the right to reschedule, delay, modify, or cancel such Services if conditions are deemed unsuitable, restricted, impractical, or unsafe.

TourThru Real Estate Marketing, LLC does not guarantee specific weather conditions, lighting conditions, aerial angles, exterior views, sunset timing, sky conditions, seasonal conditions, or other environmental conditions during the performance of Services.

Clients are encouraged to provide reasonable notice for cancellations or rescheduling requests. TourThru Real Estate Marketing, LLC reserves the right to charge cancellation, rescheduling, travel, or return-trip fees where appropriate.

7. Floor Plans & Measurements Disclaimer

Floor plans, measurements, dimensions, square footage estimates, mapping data, and similar materials provided by TourThru Real Estate Marketing, LLC are intended solely for illustrative and marketing purposes.

Such materials are not surveys, architectural drawings, engineering documents, appraisals, or legal descriptions of the property and should not be relied upon as exact representations of property dimensions, boundaries, layouts, or features.

While reasonable efforts may be made to provide accurate measurements and representations, TourThru Real Estate Marketing, LLC does not guarantee the accuracy, completeness, scale, precision, or suitability of any floor plans, measurements, dimensions, or related materials.

Clients, buyers, tenants, property owners, and other viewers are responsible for independently verifying any information they consider material, including but not limited to measurements, square footage, room dimensions, property boundaries, layouts, access points, or structural features.

TourThru Real Estate Marketing, LLC shall not be liable for any claims, damages, losses, disputes, or inaccuracies arising out of or related to the use of floor plans, measurements, dimensions, or similar materials.

8. Drone Operations

Drone photography, video, and related aerial Services provided by TourThru Real Estate Marketing, LLC are subject to weather conditions, lighting conditions, FAA regulations, airspace restrictions, equipment limitations, property conditions, safety considerations, and other operational factors beyond our control.

TourThru Real Estate Marketing, LLC reserves the right to delay, modify, limit, reschedule, relocate, or cancel drone-related Services at any time if conditions are determined to be unsafe, restricted, impractical, or otherwise unsuitable in our sole discretion.

The client acknowledges that certain aerial perspectives, flight paths, property views, altitudes, angles, neighboring areas, landmarks, or environmental conditions may not be achievable due to legal, safety, technical, environmental, or operational limitations.

Drone Media may incidentally capture neighboring properties, vehicles, structures, landscaping, streets, or surrounding areas visible from lawful airspace. The client is responsible for obtaining any permissions or approvals they believe are necessary for requested drone operations associated with the property or project.

TourThru Real Estate Marketing, LLC does not guarantee the availability, legality, or completion of drone-related Services at any specific property or location.

9. Links to Other Websites

Our Service may contain links to third-party websites, platforms, software, hosting providers, mapping services, social media platforms, or other services that are not owned or controlled by TourThru Real Estate Marketing, LLC.

TourThru Real Estate Marketing, LLC has no control over and assumes no responsibility for the content, privacy policies, terms, practices, availability, or functionality of any third-party websites or services. We do not endorse or warrant any third-party offerings, products, services, or websites.

You acknowledge and agree that TourThru Real Estate Marketing, LLC shall not be responsible or liable, directly or indirectly, for any damage, loss, or claim caused or alleged to be caused by or in connection with your use of or reliance upon any third-party content, goods, services, or websites.

We encourage you to review the terms, conditions, and privacy policies of any third-party websites or services that you access.

10. Termination

TourThru Real Estate Marketing, LLC reserves the right to refuse, suspend, limit, or terminate access to the Service or discontinue Services at any time, with or without notice, for any reason, including but not limited to violations of these Terms, unlawful conduct, abusive behavior, safety concerns, nonpayment, misuse of Media, or other conduct deemed inappropriate at our sole discretion.

You may discontinue use of the Service at any time.

Termination or discontinuation of Services does not affect any rights, obligations, licenses, payment responsibilities, or provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property rights, Media ownership provisions, indemnification obligations, disclaimers, limitations of liability, and payment obligations.

11. Indemnification

You agree to defend, indemnify, and hold harmless TourThru Real Estate Marketing, LLC, its members, employees, contractors, agents, officers, directors, licensors, and service providers from and against any and all claims, demands, damages, losses, liabilities, judgments, settlements, costs, expenses, or debts, including reasonable attorney's fees and legal expenses, arising out of or related to:

(a) your use of the Service or Media;

(b) your violation of these Terms;

(d) any dispute relating to property ownership, access authorization, occupant consent, tenant notification, privacy concerns, or publication rights related to a property or project for which Services were requested; or

(e) your misuse, unauthorized use, or unlawful use of the Media or Service.

12. Limitation of Liability

To the fullest extent permitted by applicable law, TourThru Real Estate Marketing, LLC, including its members, employees, contractors, agents, affiliates, licensors, and service providers, shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or speculative damages arising out of or related to the Service, the Media, or the performance or nonperformance of Services.

This includes, without limitation:

loss of profits
loss of business opportunities
loss of listings or sales
delays in marketing
loss of data
hosting interruptions
third-party platform issues
MLS or brokerage rejection of Media
weather-related delays
drone operation limitations
scheduling issues
property access issues
or any other intangible or consequential losses

TourThru Real Estate Marketing, LLC does not guarantee any particular marketing result, property sale outcome, leasing result, lead generation result, website availability, hosting uptime, or uninterrupted access to the Service.

In all cases, the total cumulative liability of TourThru Real Estate Marketing, LLC arising out of or relating to the Service or any Services provided shall not exceed the total amount actually paid by the client for the specific Services giving rise to the claim.

These limitations apply regardless of the legal theory asserted, including contract, tort, negligence, strict liability, or otherwise, even if TourThru Real Estate Marketing, LLC has been advised of the possibility of such damages.

13. Disclaimer

Your use of the Service and Media is at your sole risk. The Service, Media, hosted content, and all related Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or course of performance.

TourThru Real Estate Marketing, LLC does not warrant or guarantee:

uninterrupted or error-free operation of the Service;
continuous availability of hosted tours or Media;
compatibility with all third-party platforms, MLS systems, devices, browsers, or services;
acceptance of Media by any MLS, brokerage, platform, or third-party service;
the accuracy of floor plans, measurements, mapping data, or property-related information;
specific marketing, sales, leasing, or business results;
uninterrupted drone operations or availability due to weather, FAA restrictions, property conditions, safety concerns, or technical limitations.

Media created by TourThru Real Estate Marketing, LLC may include editing, enhancement, color correction, HDR processing, sky replacement, perspective correction, object removal, or other visual adjustments intended for marketing presentation purposes. Final Media may not perfectly reflect current property conditions, lighting conditions, colors, dimensions, views, furnishings, landscaping, weather conditions, or other real-world characteristics.

Clients and viewers are responsible for independently verifying any property information, measurements, features, dimensions, boundaries, or conditions they consider material.

14. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, certain limitations or exclusions contained in these Terms may not apply to you to the extent prohibited by applicable law.

15. Governing Law

These Terms and any disputes arising out of or relating to the Service or Services provided by TourThru Real Estate Marketing, LLC shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between the parties regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings relating to the Service unless otherwise agreed in writing.

16. Changes

TourThru Real Estate Marketing, LLC reserves the right to modify, update, or replace these Terms at any time at our sole discretion.

If we make material changes to these Terms, we will make reasonable efforts to provide notice prior to such changes taking effect, including by updating the effective date of these Terms or posting notice on the Service.

By continuing to access or use the Service after revised Terms become effective, you agree to be bound by the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.

17. Owner / Tenant Privacy

TourThru Real Estate Marketing, LLC respects the privacy of property owners, occupants, tenants, and other individuals associated with properties featured in the Media or Service.

Clients are responsible for reviewing delivered Media and notifying TourThru Real Estate Marketing, LLC of any requested privacy-related edits or concerns prior to publication or distribution whenever reasonably possible. This may include, but is not limited to:

family photographs
personal documents
financial information
computer screens
security systems
license plates
artwork
business information
or other sensitive or personally identifiable content

Clients are also responsible for notifying TourThru Real Estate Marketing, LLC if a property should no longer be publicly displayed through hosted tours, property pages, or related Media following the completion of a sale, lease, transfer, or marketing campaign.

While reasonable efforts may be made to accommodate privacy-related requests, TourThru Real Estate Marketing, LLC does not guarantee the removal of Media from third-party platforms, syndicated listings, search engines, archived pages, screenshots, cached content, or other third-party systems beyond our direct control.
